6. Plans and Payment

6.1. The right to use the Service may be granted for a fee or free of charge, depending on the plan selected by the User. Current information on plans, their prices, functionality and duration is available in the Service interface.

6.2. The Right Holder’s fee for the selected plan is paid by the User in full in advance by non-cash payment through the payment systems integrated into the Service. The User enters bank card details on the payment system’s side; the Right Holder does not receive or store them.

6.3. The User may link their bank card to the User Account for recurring automatic payments to renew the plan. The User agrees to automatic debiting of their card at the end of the current paid period for the next equivalent period. The User may cancel automatic renewal (recurring payments) at any time in their account settings.

6.4. The User’s payment obligations are fulfilled once the funds reach the Right Holder’s bank account.

6.5. If the User terminates the Agreement early, the fee for the paid but unused period is refunded in proportion to the number of days remaining in the paid period, less the Right Holder’s actual costs (including payment system fees), unless otherwise provided by Russian consumer protection law. To request a refund, the User sends a request to support@amberapp.app or contacts the Right Holder in any form through the Service’s built-in features.

7.2. The User’s personal data is processed for analytics and measuring advertising effectiveness only with the User’s separate consent (https://amberapp.app/consent). This consent is not a condition of the Agreement, and the Service can be used in full without it.

7.3. The Right Holder guarantees the confidentiality of the User’s personal data and provides an appropriate level of protection against unauthorised access by third parties to the User Account.

7.4. The User is the operator (controller) of the personal data of the User’s Clients. The User warrants that they have a legal basis for processing their Clients’ personal data, including for engaging the Right Holder to process it, and, where required, have obtained their Clients’ consent, including from Clients who book through the online booking web interface. The User is solely responsible to their Clients and to supervisory authorities for the lawfulness of processing their data using the Service.

The Right Holder is not liable for indirect losses, lost profits or loss of data caused by the User or third parties (including failures on the side of hosting providers). To the maximum extent permitted by applicable law, the Right Holder’s total liability for any claims in connection with this Agreement is limited to documented actual damage and in any case may not exceed the amount paid by the User for the Service in the preceding 12 (twelve) months.

8.5. The Right Holder has no technical or practical ability to check all information (User Content) the User posts in the Service for compliance with Russian law and the Agreement, as such checks would make the Service unworkable. The Right Holder may check such content at its own discretion (for example, upon receiving complaints). The Right Holder is not liable for such content, its compliance with Russian law or any violation of the rights and legitimate interests of third parties.

9. Dispute Resolution
